As of last Monday document looking to extend process had not arrived. Time limit is 15 days
The petitioning party in the polemic ZM nightclub case has informed us that as of Monday 18th July they still had not received any notification of the sentence verdict. There is still time to go- 15 working days from the date of notification – but prosecuting lawyer Jesus Tolmo has assured that the contentious-administrative nature of the ruling means that it cannot be appealed as the resolution looks to revoke a licence. This type of resolution, according to existing administrative law, only permits one shot at a lawsuit. In any case, the complainant is expectant that the court or other judicial sections confirm the possibility of opening proceedings which leaves the ruling of the sentence on hold, an action which duly corresponds to Cartagena Council .
Attitude of town hall
Jesús Tolmo has expressed his surprise with the attitude of the town hall as he stated, “The council suspected ZM of tampering with the sound meter last summer, a device installed to measure decibel levels in nightclubs”. Visión La Manga has wanted to gather the opinion of ZM’s owners but they have refused to comment.
